Abstract

Substance and Material of Legislation explores the fundamental aspects of legislation in Indonesia particularly focusing on the legal substance and the materials that constitute laws. It emphasizes the importance of understanding the legislative process, which includes the planning, drafting, discussion, ratification and promulgation stages of lawmaking. The research highlights that effective legislation is not only about creating laws but also involves ensuring that these laws are coherent, comprehensive and aligned with the societal needs and values. The study further discusses the Omnibus Law as a significant development in Indonesian legislation, aiming to simplify regulations and
enhance legal certainty. However, it identifies existing deficiencies within the legal
substance of the Omnibus Law as outlined in Law No. 13 of 2022. The article concludes
by advocating for a more structured approach to legislative drafting that incorporates public participation and thorough scrutiny to improve the quality and effectiveness of laws in Indonesia.
